Section I - PRIVATE Customers (End Consumer)
1. Scope of application
1.1 These Terms & Conditions apply to all contracts between Stylinyou e.U. (hereinafter referred to as “the Seller”) and its customers, whether concluded online via www.stylinyou.com
2. Conclusion of contract
2.1 The presentation of products on our website does not constitute a legally binding offer.
2.2 A contract is formed once the Seller accepts the customer’s order by sending an order confirmation or by delivering the goods.
2.3 Orders placed by clicking the button “Order with obligation to pay” are binding. The automatic confirmation e-mail does not yet constitute acceptance of the offer.
3. Prices and shipping costs
3.1 All prices are stated in euros (€) and include statutory VAT.
3.2 Shipping costs are shown separately before completing the order.
3.3 Any additional costs (e.g. customs duties for non-EU countries) are borne by the customer.
4. Payment
4.1 Payments are due immediately upon order.
4.2 Accepted payment methods: credit card, PayPal, or cash / card payment for purchases made through an authorized representative.
5. Delivery
5.1 Deliveries are made within 4–5 business days, unless otherwise specified.
5.2 Delivery is made to the address provided by the customer. The customer is responsible for any additional costs caused by incorrect address details.
5.3 Digital products (e.g. e-books) are provided as downloads. A non-exclusive, non-transferable right of use is granted for private purposes only.
6. Right of withdrawal (for consumers)
6.1 Consumers have the right to withdraw from the contract within 14 days without stating reasons.
6.2 The withdrawal period begins on the day the consumer or a third party designated by them receives the goods.
6.3 To exercise the right of withdrawal, the consumer must send a clear statement (by e-mail or letter) before the deadline expires.
6.4 If the contract is withdrawn, we will refund all payments, including standard delivery costs, within 14 days after we have received the returned goods or after you have provided proof that you have sent them back, whichever occurs first.
Refunds are made using the same payment method as in the original transaction.
6.5 The customer bears the direct cost of returning the goods, unless otherwise agreed.
6.6 The right of withdrawal does not apply to:

goods made to customer specifications or clearly personalized,
-
sealed goods which are unsuitable for return for health or hygiene reasons once unsealed,
-
digital content (e.g. downloads) once the download process has begun and the customer has expressly consented to the early start of performance.
7. Retention of title
The goods remain the property of the Seller until full payment has been received.
8. Warranty
8.1 Statutory warranty rights apply.
8.2 Minor color or size deviations in product images may occur due to technical reasons and do not constitute defects.
8.3 Customers are encouraged to report any defects promptly by e-mail to info(at)stylinyou.com
9. Liability
9.1 Liability is governed by statutory provisions.
9.2 Liability for slight negligence is excluded, except in cases of personal injury or claims under the Product Liability Act.
10. Data protection
Personal data is processed in accordance with the EU General Data Protection Regulation (GDPR) and Austrian Data Protection Act (DSG 2018).
Customers have rights to access, rectification, deletion, restriction of processing, data portability, and objection.

11. Consumer dispute resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
If no amicable solution can be reached, we will inform consumers in accordance with Section 19 (3) AStG on a durable medium about the competent arbitration body and state whether we will participate.
(Note: The former EU Online Dispute Resolution (ODR) platform was permanently discontinued in July 2025.)
12. Place of jurisdiction and applicable law
12.1 Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
12.2 For consumers within the EU, mandatory consumer protection laws of their country of residence remain unaffected.
12.3 The exclusive place of jurisdiction for business customers is Vienna. For consumers, the place of jurisdiction is their place of residence.
Section II - BUSINESS Customers

Defects must be reported immediately, but no later than four working days after receipt.

The Seller determines the method of rectification.

Claims for damages expire after 12 months from the transfer of risk.

Place of performance is Klosterneuburg; competent court is Vienna.
